Pennsylvania Small Estates: the small estate petition

Pennsylvania calls its simplified route the small estate petition, and it is set out in 20 Pa.C.S. § 3102. This is a court petition, not an affidavit. Real estate doesn't count toward the limit and can't pass this way. Pennsylvania sets no waiting period for it. It does not transfer real estate. Creditor claims under 20 Pa.C.S. §§ 3162, 3532

Above the limit it is a regular Pennsylvania probate case, and whoever the court appoints has to publish a notice to creditors in a local newspaper. The window for claims is no fixed cutoff, but 1 year after the first notice the estate's representative is protected from claims they didn't know about.. Paying anyone out before that window closes can leave the person who paid personally liable.[2]
